What if External affairs minister Sushma Swaraj broke standard protocol of the foreign office to help Lalit Modi obtain British travel papers when his Indian passport stood revoked, as officials said today.

What if Sushma's act of helping the former IPL commissioner ... overreach and a breach of protocol, as the officials added.

At the heart of the controversy lies a diplomatic message India had issued to the UK in 2012 amid reports that Modi, who had fled India for London in 2010, was seeking British travel documents.

What if the BJP and Swaraj's defence has hinged on the fact that all she did was discharge her duties and attempt to act in a humanitarian manner, Lalit Modi's lawyer on Monday also lauded the minister saying that his client had always been in compliance with British laws.

"No proceedings in any court of law has declared him an offender or a fugitive. He is staying in London with the full knowledge of and complying with British laws," Mehmood M Abdi said. Abdi said the Interpol secretariat had clarified that there was no "blue notice" against Modi.

What if speaking on the Buck Stops Here on NDTV, former diplomat KC Singh also agreed with the fact that many Indian investigating agencies used the revoking of the passport as a means to harass a person accused in a case. However, he was very clear about one thing. What Swaraj did was wrong. "Even if it was (done for) Mother Teresa it wasn't right," Singh said.

He pointed out that the minister should have ideally issued a notice to the Enforcement Directorate, understood the status of the notice issued against Modi years earlier and whether they intended to take action. At no point so far has the government stated that Swaraj contacted the ministry of finance, under which the enforcement directorate operates, or Finance Minister Arun Jaitley.

As media reports,Finance minister Arun Jaitley said this while addressing a press conference along with home minister Rajnath Singh at North Block to announce a financial package to Jammu and Kashmir.

"All accusations are baseless, she and party president have said she acted bona fide," said Jaitley.

Confronted with queries about Swaraj's intervention to facilitate travel documents for the former IPL boss, who is under the scanner of the Enforcement Directorate in various FEMA and PMLA cases, the finance minister reiterated the government's stance in the case and batted for the beleaguered minister at the press conference.

He said, "The entire government and party are one on the matter on which there should be no doubt."

While the government and the Bharatiya Janata Party (BJP) have already backed Swaraj, the opposition Congress has kept up the pressure on the NDA regime.

A day after its vice-president Rahul Gandhi hit out at the government demanding the Prime Minister sack Swaraj, opposition party's deputy leader in Rajya Sabha Anand Sharma also accused the PM of helping the former IPL boss.

Sharma demanded that a special investigation team be set up by the Supreme Court into allegations of nexus between BJP leaders and the scam-tainted former IPL boss.

"We demand a detailed probe. This govt can't be trusted so the Supreme Court should set up an SIT," Congress leader Anand Sharma said at a press conference over reports which said Swaraj helped facilitate travel papers for Modi who has been charged with alleged financial impropriety.

He said the issue was not merely about Modi's travel papers but about a "nexus" which involved the "senior leadership of the government involved in cricket management."

He also questioned Prime Minister Narendra Modi's silence on the matter saying there cannot be two sets of rules on probity.

Sharma's colleague and Congress general secretary Digvijaya Singh too questioned the government's silence over Modi.

"I want to ask the Prime Minister, I want to ask finance minister, why are they keeping quiet? We would like to know whether Lalit Modi is evading tax? Why is he not coming to India? Is there a blue or red corner notice against him? Is he an absconder? Is he a fugitive? We want to know," Singh said.

Earlier, Union environment minister Prakash Javadekar said that the matter had ended after the external affairs minister offered a clarification.

Referring to pictures being dug up by Congress showing Modi with BJP leaders, he said those were old photographs dating back to 2010.

"That time Lalit Modi was IPL chairman. There was no accusation against him, he was not charged. Narendra Modi was Gujarat chief minister and also the chairman of Gujarat Cricket Association. Amit Shah was vice-chairman of the cricket association. So, Congress has lost the plot," Javadekar said in Chennai.

He added that there were also pictures of Congress leaders with Lalit Modi and that opposition parties were silent about that.
