On March 17, 2025, in Wikimedia Foundation Inc. vs. ANI Media Private Limited & Ors. (2025), Justices Abhay S. Oka and Ujjal Bhuyan observed: "We are concerned with the legality and validity of the directions issued by the High Court in paragraph 5 of the impugned order. Issue notice only to the first respondent, returnable on 4th April, 2025. The learned Advocate-on-Record, takes notice on behalf of the first respondent. Counter affidavit to be filed by the end of this month."
The case arose out of impugned final judgment and order dated October 16, 2024 passed in Wikimedia Foundation Inc. vs. ANI Media Private Limited (FAO(OS)-146/2024) by Delhi High Court's Division Bench of Justices Manmohan and Tushar Rao Gedela. It was filed in the Supreme Court on January 15, 2025.
The Supreme Court has issued notice on a petition filed by Wikimedia Foundation against an order passed by the Delhi High Court directing the removal of a Wikipedia page and discussions related to ongoing defamation proceedings initiated by news agency Asian News International (ANI) against Wikipedia. Wikimedia Foundation had submitted before the High Court that it is an intermediary, consequently, the burden to prove that the content is not defamatory is on the editors.
