Police of Murshidabad is above the law, they can torture any personwith IMPUNITY.

I lodge this present complaint in the matter of arbitrary arrest, custodial violence and illegal detention of Mr. Sujoy Kumar Chowdhury of District-Murshidabad, West Bengal by the police personnel of Islampur Police Station under the same district. Our attached fact finding report gives details of the incident. The victim lodged written complaint against the police personnel before the Superintendent of Police, Murshidabad for taking action against the perpetrators, but till date there is no action.

The incident is against the Constitutional guarantee in accordance to Articles 21 and 22 of Indian Constitution. It again in contravention of articles 6,7 and 8 of International Covenant on Civil and Political Rights; Government of India is the signatory of this international instrument. It further strengthens our long standing demand for immediate ratification of UN Convention Against Torture by Indian state.  

Due to gross human rights violation of the victim I seek your urgent intervention in this matter in the following manner:-
·         The whole matter must be enquired into by one neutral authority appointed by the Commission.
·         The perpetrator police personnel must be booked under the law for their gross illegal activities and punished accordingly.
·         The complaint of the victim must be acknowledged immediately and proper must be directed to be taken on the same by the concerned authorities.
·         The victim should be provided with adequate compensation and protection

Name of the victim: - Mr. Sujoy Kumar Chowdhury, son of Mr. Madhusudan Chowdhury, by faith-Hindu, by caste-Schedule Caste,  by occupation-Barber, residing at village-Goas, Police Station-Islampur, District-Murshidabad, West Bengal, India.

Particulars of the perpetrators: - (1) Mr. Biplab Karmakar(Officer-in-Charge of Islampur Police Station; (2) Mr. Kabisankar Pal(Sub-Inspector of Police of Islampur Police Station); (3)Mr. Sujit Majumdar(Assistant Sub-Inspector of Police of Islampur Police Station) and (4) Mr. Sajahan Ali (Assistant Sub-Inspector of Police of Islampur Police Station.

Date & time of the incident: - On 6.4.2015 at about 11.50 pm and subsequent thereafter.

Place of incident: - At the residence of the victim and Islampur Police Station.

Fact Finding Details:-
It is revealed during the fact finding that the victim is barber by profession and he works in the saloon of Mr. Gour Pramanik to earn his livelihood. On 6.4.2015 at about 11.50 pm he was sleeping with his family members in his residence. At that time four police personnel from Islampur Police Station namely Mr. Biplab Karmakar (Officer-in-Charge of Islampur Police Station), Mr. Kabisankar Pal (Sub-Inspector of Police of Islampur Police Station), Mr. Sujit Majumdar (Assistant Sub-Inspector of Police of Islampur Police Station) and Mr. Sajahan Ali (Assistant Sub-Inspector of Police of Islampur Police Station) entered into his residence. Those police personnel were in plain clothes. The victim was taken up from sleep and they attempted to forcibly drag him out from his residence. He asked the said police personnel the reason of such unruly behavior, but the police personnel abused him and indiscriminately assaulted him by fists and blows. The victim's wife tried to save him but she was abused in filthy languages by the perpetrator police personnel in absence of any lady police personal.

The perpetrator police personnel brought out the victim from his residence and put him into police vehicle while committing assault upon him incessantly. He was brought at Islampur Police Station and again he was subjected to physical assault in the police station. He was detained in the police lock up. On the next day he was taken to a room in the said police station and he was subjected to both mental and physical torture.

On 8.4.2015 at about 10 am he was put into a car and the car stopped in front of Islampur Rural Hospital. After a while he was brought back to Islampur Police Station and at noon he was produced at Sub-Divisional Magistrate Court Lalbagh Court implicating him in a criminal case i.e. NGR Case no.1321/2015(Islampur Police Station GDE no.356 dated 7.4.2015 & GDE no.358 dated 7.4.2015) under section 42 of Cr. P. C. & 290 of IPC. In the said case it was alleged against him that on 7.4.2015 at about 19.45 hours he was making hue and cry in a drunken of wine condition. On 8.4.2015 he was released on bail from the court. On 9.4.2015 he was medically treated at Islampur Police Station and the injury notes recorded bruise on buttock of the victim for three days.

On 13.4.2015 the victim submitted one written complaint before the Superintendent of Police, Murshidabad stating the incident of illegal arrest, illegal detention in police station and custodial violence committed upon him but till date no action has been taken on his complaint.
