In Akhil Bhartiya Vishwakarma Mahasabha, Bihar vs. Union of India through the Registrar General, Government of India & Ors.(2025), Patna High Court's Division Bench of Chief Justice P. B. Bajanthri and Justice Alok Kumar Sinha delivered a 2-page long judgement dated September 26, 2025, wherein it disposed of the writ petition. Chief Justice Bajanthri authored the Judgement.
Chief Justice Bajanthri concluded:''when member(s) of the Lohra/Lohara Caste files application, in that event, the concerned Revenue Authority is hereby directed to examine whether particular person who has filed application for issuance of Caste Certificate really belongs to Lohra/Lohara Caste or not with reference to spot mahajar and other issues and thereafter proceed to issue Caste Certificate strictly in accordance with the relevant provisions of the law. If such application(s) is submitted, the concerned authority is hereby directed to take note of and decide within a period of four months from the date of receipt of application.''
The other seven respondents were: Secretary, Ministry of SC & ST Welfare Department, Government of India,
Commissioner of Census, Government of India, State of Bihar through its
Chief Secretary, Government of Bihar, Principal Secretary, Department
of SC/ST Welfare, Government of Bihar, Secretary, Department of
Administration, Government of Bihar, All the District Magistrates cum
Collectors, Bihar and All the Circle Officers, Bihar.Basant Kumar Choudhary, senior counsel and Advocate Naresh Prasad, represented the petitioner. The case was filed in the High Court on June 20, 2025 and registered on July 30, 2025.
