Indira Jaising demands disclosure of 3-Member Committee report, copy of the reply of Justice Yashwant Varma and name of the "donor" must be made public as well

Reacting to the press release dated May 8, 2025 issued by the Supreme Court of India, Indira Jaising, the noted jurist said, "The copy of the report must be made public and available to all of us."The press release states that Justice Sanjive Khanna, Chief Justice of India has written to the President of India and the Prime Minister of India enclosing therewith copy of the 3-Member Committee report dated May 3, 2025 along with the letter/response dated May 6, 2025 received from Justice Yashwant Varma. This has been done in terms of the In-House Procedure, the release claimed. The 3-member enquiry committee was constituted on the basis of an enquiry report submitted by Delhi High Court's Chief Justice D.K. Upadhyaya.

Citizens Forum for Civil Liberties (CFCL) has demanded disclosure of the reply of Justice Varma in response to the inquiry report as well. The information about the donor, if any, must also be made public. CFCL asked, can there be a recipient of "cash" without a donor?

The in-house procedure is laid down by the Supreme Court in the Additional District and Sessions Judge versus Registrar General, High Court of Madhya Pradesh in it's decision dated December 18, 2014.

Under Article 217 of the Constitution provides the motion to remove the judge must be supported by a special majority of each House of Parliament. A special majority is a majority of the total membership of that House and a majority of at least two-thirds of the members of that House present and voting.
