Amidst bitter resentment among all the Advocates of the High Court, Patna High Court did not deliver any judgment on September 17, 2025, it passed some 265 orders including the one In- Re in the matter of assault on the Advocate Shri Anshul Aryan vs. The State of Bihar Through the Director General of Police Bihar, Patna & Ors. (2025), wherein, Patna High Court's Division Bench of Acting Chief Justice P. B. Bajanthri and Justice Alok Kumar Sinha passed a 2-page order dated September 17, 2025.
The Court's order recorded that a Criminal Writ Jurisdiction Case of 2025 was filed by Advocate Manogya Singh, who is a victim of assault by the guards of Delhi Public School who was assaulted along with Advocate Anshul Aryan. This was only order passed by the bench of Justices Bajanthri and Sinha on September 17, 2025.
The order reads:''2. Registry is hereby directed to list the aforementioned fresh petition along with the present petition (Cr.W.J.C. No.2415 of 2025). 3. Similarly, in the present Cr.W.J.C. No.2415 of 2025), Anshul Aryan (petitioner) has filed a petition. The same shall be tagged. 4. Re-list this matter on 24.09.2025. 5. In Cr.W.J.C. No.2415 of 2025, in the light of our previous order, learned Advocate General on instruction submitted that there were complaints and counter complaints. The concerned Investigating Officer is stated to have filed charge-sheet before the Jurisdictional Forum. The same is taken note of in both the cases.'' Justice Sinha observed that it is noteworthy that the previous order was passed by another Division Bench of equal strength.
Notably, on September 9, 2025, High Court's Division Bench of Justices Rajeev Ranjan Prasad and Sourendra Pandey heard the "Criminal Writ Jurisdiction (Suo Motu) Case" In - Re in the matter of Assault on the Advocate. Ramakant Sharma and Yogesh Chandra Verma, Senior Advocates and members of Bihar State Bar Council appeared in the case. The 2-page long order dated was authored by Justice Prasad after it was mentioned before the Division Bench-3, being Criminal Application and Motion Bench by the Senior Advocates and by these members of the Bihar State Bar Council. The order records that ''They pointed out the occurrence which has taken place in the morning yesterday at 10:15 A.M. in which the Advocate Ansul Aryan and his wife Manogya Singh who is also an Advocate of this Court were badly assaulted by the guards deputed outside the DPS School. 2. It is the grievance that despite the complaint made to the SHO, Rupaspur Police Station, the police has not taken any action as yet. Some photographs of the Advocate in injured condition and bleeding near the vital part of his body i.e. eye-brow have been produced before this Court.''
The order of the Division Bench-3 reads: ''3. This court directs the registration of suo motu criminal writ application title "In - Re in the matter of Assault on the Advocate" after seeking permission of Hon'ble the Acting Chief Justice. 4. The Registrar General of this Court is directed to inform the Sr. S.P., Patna about the matter and let the SHO, Rupaspur Police Station appear in person tomorrow at 10:30 A.M."
The matter was be listed before the Court of the Acting Chief Justice on September 10, 2025 and on September 17, 2025. The order dated September 10 and order dated September 17 were passed.
Aggrieved by the insensitive approach of Court No. 2 of the Acting Chief Justice, and because the Advocates/the Bar did not get sympathetic hearing from the Bench, all the three advocate associations were constrained to pass a resolution after deliberating over the assault on both the advocates. Both Advocate Manogya Singh's and Advocate Anshul Arya, her husband faced assault by the guards of Delhi Public School. Later in the evening of September 17, all the office bearers of three associations were approached to settle the matter amicably. The details regarding the response of the associations is awaited.
The unanimous resolution dated September 17, 2025 by the three association is as under:
RESOLUTION
The Coordination Committee of three Association of Patna High Court met on 17.09.2025 at 01.30 P.M. to discuss the situation that has arisen after the assault of two young lawyers (Husband and wife) by the Staff/ Security Officer, bus driver and conductor of Delhi Public School, when the two lawyers were on the way to the Patna High Court for their professional work. The lawyer Ansul Aryan suffered injuries while his wife Manogya Singh was subjected to verbal abuse and intimidating Sexual Posturing. Mobile in her hand was Snatched and broken.
This was brought to the notice of the Criminal Motion Bench of Patna High Court. The Division Bench taking cognisance of the aforesaid assault on two lawyers the hon'ble court by on order dated 09.09.2025 directed personal appearance of S.H.O. Rupaspur Police Station, Patna. The learned Court thereafter directed the Registry to register suo moto criminal writ application titled "In the matter of Assault on the Advocate" after seeking permission of Hon'ble Acting Chief India. The matter was thereafter listed before the Bench of Hon'ble ACJ and Hon'ble Mr. J. Alok Kumar Sinha on 10.09.2025, wherein the Hon'ble Bench framed an issue "whether Suo Moto Judicial notice could be taken and seeking formal approval of Acting Chief Justice on administrative side is correct or not". And the Hon'ble Court Proceeded to Dispense with the personal appearance of SHO, Rupaspur Police Station whose appearance had been directed by the coordinate Division Bench on 09.09.2025.
Today, 17.09.2025, where the matter was taken up, the Hon'ble Court directed for two criminal writ application to be listed and the matter was adjourned for next week. The Bar represented by many eminent senior leaders alongwith the representatives of Coordination Committee made a request that the order dated 10.09.2025 be recalled, since order of one Coordinate Bench Could not have been interfered by another Coordinate Bench and that it was reflecting poorly on the Patna High Court.
The members of the Bar felt that the Bench Presided by Acting Chief Justice was not Sensitive about the real issue i.e. assault on the two lawyers by a School, whose management is famed to have deep inroads into corridors of Power. The Bar feels that the Hon'ble Court was somehow trying to linger the matter of the real issue of assault and diffuse the matter.
Considering the above and also the anguish & sentiment of the members of Bar, the Coordination Committee unanimously resolves to henceforth indefinitely abstain and boycott the Court of Hon'ble Acting Chief Justice form the morning of 18th Sept. 2025. The Resolution be Communicated to Registrar General for the needful.
